The CPIA provides a means by which authorized qualified entities can have access to national criminal history background checks for determinations of whether covered individuals have been convicted of, or are under pending indictment for, a crime that bears upon their fitness to have responsibility for the safety and well-being of children, the elderly, or individuals with disabilities. As required by the CPIA, these proposed regulations would establish the criteria to be utilized by an entity designated by the Federal Bureau of Investigation (FBI) to make these determinations.","document_number":"2023-18194","html_url":"https://www.federalregister.gov/documents/2023/08/25/2023-18194/child-protection-improvements-act-criteria-for-designated-entity-determinations","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2023-08-25/pdf/2023-18194.pdf","public_inspection_pdf_url":"https://public-inspection.federalregister.gov/2023-18194.pdf?1692881118","publication_date":"2023-08-25","agencies":[{"raw_name":"DEPARTMENT OF JUSTICE","name":"Justice Department","id":268,"url":"https://www.federalregister.gov/agencies/justice-department","json_url":"https://www.federalregister.gov/api/v1/agencies/268","parent_id":null,"slug":"justice-department"},{"raw_name":"Federal Bureau of Investigation","name":"Federal Bureau of Investigation","id":160,"url":"https://www.federalregister.gov/agencies/federal-bureau-of-investigation","json_url":"https://www.federalregister.gov/api/v1/agencies/160","parent_id":268,"slug":"federal-bureau-of-investigation"}],"excerpts":"The Department of Justice is proposing to promulgate regulations (\"proposed rule\" or \"rule\") concerning the Child Protection Improvements Act of 2018 (\"CPIA\"). This law authorizes a fingerprint-based check of state and national criminal history records to screen prospective and current private security officers and requires the Attorney General to issue rules to regulate the \"security, confidentiality, accuracy, use, submission, dissemination, destruction of information and audits, and record keeping\" of the criminal history record information (CHRI) and related information; standards for qualifying as an authorized employer; and the imposition of fees.","document_number":"06-223","html_url":"https://www.federalregister.gov/documents/2006/01/11/06-223/implementation-of-the-private-security-officer-employment-authorization-act-of-2004","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2006-01-11/pdf/06-223.pdf","public_inspection_pdf_url":null,"publication_date":"2006-01-11","agencies":[{"raw_name":"DEPARTMENT OF JUSTICE","name":"Justice Department","id":268,"url":"https://www.federalregister.gov/agencies/justice-department","json_url":"https://www.federalregister.gov/api/v1/agencies/268","parent_id":null,"slug":"justice-department"},{"raw_name":"Federal Bureau of Investigation","name":"Federal Bureau of Investigation","id":160,"url":"https://www.federalregister.gov/agencies/federal-bureau-of-investigation","json_url":"https://www.federalregister.gov/api/v1/agencies/160","parent_id":268,"slug":"federal-bureau-of-investigation"}],"excerpts":"The Department of Justice (the Department) hereby amends title 28 of the Code of Federal Regulations to authorize access to FBI- maintained criminal justice information systems to effectuate the Private Security Officer Employment Authorization Act of..."},{"title":"Screening of Aliens and Other Designated Individuals Seeking Flight Training","type":"Rule","abstract":"Under section 113 of the Aviation and Transportation Security Act, certain aviation training providers subject to regulation by the Federal Aviation Administration are prohibited from providing training to aliens and other designated individuals in the operation of aircraft with a maximum certificated takeoff weight of 12,500 pounds or more, unless the aviation training provider notifies the Attorney General of the identity of the candidate seeking training and the Attorney General does not notify the aviation training provider within 45 days that the candidate presents a risk to aviation or national security. On June 14, 2002, the Department issued two rulemaking documents, a proposed rule and an interim final rule, requesting comments on both documents. This final rule implements the Flight Training Candidate Checks Program, by which aviation training providers will provide the required notification for specific categories of flight training candidates. The final rule also sets forth how aviation training providers may begin or resume instruction for candidates whom the Attorney General has determined do not present a risk to aviation and national security as a result of the risk assessment conducted pursuant to section 113 of the Aviation and Transportation Security Act.","document_number":"03-3384","html_url":"https://www.federalregister.gov/documents/2003/02/13/03-3384/screening-of-aliens-and-other-designated-individuals-seeking-flight-training","pdf_url":"https://www.govinfo.gov/content/pkg/FR-2003-02-13/pdf/03-3384.pdf","public_inspection_pdf_url":null,"publication_date":"2003-02-13","agencies":[{"raw_name":"DEPARTMENT OF JUSTICE","name":"Justice Department","id":268,"url":"https://www.federalregister.gov/agencies/justice-department","json_url":"https://www.federalregister.gov/api/v1/agencies/268","parent_id":null,"slug":"justice-department"}],"excerpts":"Under section 113 of the Aviation and Transportation Security Act, certain aviation training providers subject to regulation by the Federal Aviation Administration are prohibited from providing training to aliens and other designated individuals in the..."},{"title":"Screening of Aliens and Other Designated Individuals Seeking Flight Training","type":"Proposed Rule","abstract":"Under section 113 of the Aviation and Transportation Security Act, certain aviation training providers subject to regulation by the Federal Aviation Administration (\"FAA\") are prohibited from providing training to aliens and other designated individuals in the operation of aircraft with a maximum certificated takeoff weight of 12,500 pounds or more, unless the aviation training provider notifies the Attorney General of the identity of the alien seeking training and the Attorney General does not direct the aviation training provider within 45 days that the alien presents a risk to aviation or national security.
